Gebruiksvoorwaarden AI Skin Test

In deze voorwaarden lees je hoe je de AI Skin Test mag gebruiken en wat je er wel en niet van mag verwachten. Lees ze even door voordat je begint. We houden ze bewust kort en duidelijk.

1. Wie wij zijn en waar deze voorwaarden over gaan

De AI Skin Test wordt aangeboden door Pascaud Care B.V., Oosteinde 1, 2991 LG Barendrecht, Nederland, ingeschreven bij de Kamer van Koophandel onder nummer 73223719 ("Pascaud", "wij", "ons"). De test draait op technologie van Haut.AI, dat voor ons werkt als dienstverlener.

Deze voorwaarden gelden voor je gebruik van de AI Skin Test op pascaud.com. Door de test te starten ga je ermee akkoord. Hoe we met je persoonsgegevens omgaan, lees je in onze privacyverklaring op pascaud.com/pages/privacy.

2. Wat de AI Skin Test doet

In de test beantwoord je een paar vragen en maak of upload je een foto van je gezicht. De test analyseert vervolgens je huid en geeft je scores, een persoonlijke routine met Pascaud-producten en, als je dat kiest, een illustratieve simulatie van hoe je huid eruit kan zien met bepaalde producten of na verloop van tijd. De simulatie is gemaakt met generatieve AI en is alleen een illustratie, geen belofte van resultaat. De test kan ook je vragen over huidverzorging beantwoorden in een korte chat.

3. Wie de test mag gebruiken

De test is bedoeld voor mensen van 16 jaar en ouder. Door de test te starten bevestig je dat je 16 jaar of ouder bent. Ben je jonger, gebruik de test dan alsjeblieft niet.

Gebruik alleen een foto van jezelf. Upload geen foto's van andere mensen, kinderen of iets anders dan je eigen gezicht, tenzij die persoon er duidelijk mee instemt en 16 jaar of ouder is.

4. Jouw toestemming

Je foto en antwoorden beschrijven je huid, wat informatie over je gezondheid kan geven. Daarom vragen we vóór de start van de test om jouw uitdrukkelijke toestemming, zoals uitgelegd in onze privacyverklaring. De test is vrijwillig. Zonder je toestemming kunnen we geen analyse maken, maar je kunt onze webshop gewoon blijven gebruiken. Je kunt je toestemming op elk moment intrekken door te mailen naar info@pascaud.com. Dat heeft geen gevolgen voor wat we eerder deden.

5. Het resultaat is indicatief en geen medisch advies

De analyse, scores, productsuggesties en simulaties zijn indicatief. Ze zijn alleen bedoeld als algemene informatie en inspiratie. Het is geen medisch advies, geen diagnose en geen behandeladvies, en de test is geen medisch hulpmiddel.

Het resultaat kan beïnvloed worden door onder meer licht, camerakwaliteit, make-up, filters en je antwoorden, dus het is niet altijd nauwkeurig. Productsuggesties geven geen garantie op een bepaald resultaat. Heb je een huidaandoening, een allergie of maak je je zorgen over je huid, praat dan met een arts of dermatoloog en lees de ingrediëntenlijst voordat je een product gebruikt. Stop met een product en vraag advies als je irritatie merkt.

6. De test goed gebruiken

Als je de test gebruikt, ga je ermee akkoord dat je niet: onjuiste of misleidende informatie geeft; de test op een onwettige of schadelijke manier gebruikt; inhoud uploadt die de rechten van anderen schendt of aanstootgevend is; bots of andere geautomatiseerde middelen gebruikt, of probeert de test of de systemen erachter te kopiëren, te ontleden, te verstoren of er ongeautoriseerd toegang toe te krijgen; of de resultaten of simulaties gebruikt om anderen te misleiden, bijvoorbeeld door ze voor te stellen als een medische beoordeling.

Houd je je niet aan deze regels, dan mogen we je de toegang tot de test ontzeggen.

7. Intellectueel eigendom

De test, de software, de analysetechnologie, het ontwerp en de inhoud zijn van Pascaud, Haut.AI of hun licentiegevers. Je mag je resultaat voor eigen persoonlijk gebruik gebruiken. De rechten op je eigen foto blijven bij jou. Je geeft ons, en Haut.AI in opdracht van ons, toestemming om je foto en antwoorden te verwerken, alleen voor de doelen en de termijnen die in onze privacyverklaring staan. Haut.AI mag daarnaast informatie die is samengevoegd of geanonimiseerd, en dus niet meer naar jou herleidbaar is, gebruiken om zijn diensten te verbeteren, zoals beschreven in die verklaring.

8. Beschikbaarheid

We doen ons best om de test werkend en nauwkeurig te houden, maar we beloven niet dat hij altijd beschikbaar is, vrij van fouten of geschikt voor jouw apparaat. We mogen de test wijzigen, pauzeren of stoppen, bijvoorbeeld voor onderhoud of vanwege technische beperkingen.

9. Aansprakelijkheid

We zijn aansprakelijk voor schade die we met opzet of door grove nalatigheid veroorzaken, en voor alles wat de wet ons niet toestaat te beperken. Daarbuiten zijn we niet aansprakelijk voor beslissingen die je neemt op basis van de indicatieve resultaten van de test, of voor tijdelijke onderbrekingen van de test. Niets in deze voorwaarden beperkt je wettelijke rechten als consument.

10. Wijzigingen in deze voorwaarden

We kunnen deze voorwaarden aanpassen. De versie en datum staan altijd bovenaan. Maken we een wijziging die voor jou van belang is, dan laten we het je weten voordat die ingaat en vragen we, als de wet dat vereist, opnieuw om je toestemming.

11. Toepasselijk recht en contact

Op deze voorwaarden is Nederlands recht van toepassing. Ben je consument, dan houd je de bescherming van de dwingende regels van het land waar je woont. Geschillen gaan naar de bevoegde rechter in Nederland, tenzij dwingend consumentenrecht je het recht geeft naar de rechter in je woonplaats te stappen. Heb je een vraag of klacht, mail ons dan eerst via info@pascaud.com, dan proberen we het samen op te lossen.

These terms explain how you may use the AI Skin Test and what you can and cannot expect from it. Please read them before you start. We keep them short and plain on purpose.

1. Who we are and what these terms cover

The AI Skin Test is offered by Pascaud Care B.V., Oosteinde 1, 2991 LG Barendrecht, the Netherlands, registered with the Dutch Chamber of Commerce under number 73223719 ("Pascaud", "we", "us"). The test runs on technology from Haut.AI, which works for us as a service provider.

These terms apply to your use of the AI Skin Test on pascaud.com. By starting the test you agree to them. How we handle your personal data is explained in our privacy policy at pascaud.com/pages/privacy.

2. What the AI Skin Test does

In the test you answer a few questions and take or upload a photo of your face. The test then analyses your skin and gives you scores, a personal routine with Pascaud products, and, if you choose, an illustrative simulation of how your skin may look with certain products or over time. The simulation is made with generative AI and is only an illustration, not a promise of results. The test can also answer your questions about skin care in a short chat.

3. Who may use the test

The test is meant for people aged 16 or older. By starting the test you confirm that you are 16 or older. If you are younger, please do not use it.

Use only a photo of yourself. Do not upload photos of other people, children or anything that is not your own face, unless that person has clearly agreed and is 16 or older.

4. Your consent

Your photo and answers describe your skin, which can reveal information about your health. We therefore ask for your explicit consent before the test starts, as explained in our privacy policy. The test is voluntary. Without your consent we cannot make the analysis, but you can still use our webshop. You can withdraw your consent at any time by writing to info@pascaud.com. This does not affect what we did before.

5. The result is indicative, not medical advice

The analysis, scores, product suggestions and simulations are indicative. They are for general information and inspiration only. They are not medical advice, a diagnosis or a treatment suggestion, and the test is not a medical device.

Results can be affected by things like lighting, camera quality, make-up, filters and your answers, so they may not always be accurate. Product suggestions do not guarantee a certain result. If you have a skin condition, an allergy, or a concern about your skin, speak to a doctor or dermatologist, and check the ingredient list before you use a product. Stop using a product and seek advice if you notice irritation.

6. Using the test properly

When you use the test, you agree that you will not: give false or misleading information; use the test in an unlawful or harmful way; upload content that infringes the rights of others or is offensive; use bots or other automated means, or try to copy, reverse engineer, disrupt or get unauthorised access to the test or the systems behind it; or use the results or simulations to mislead others, for example by presenting them as a medical assessment.

If you do not follow these rules, we may block your access to the test.

7. Intellectual property

The test, its software, analysis technology, design and content belong to Pascaud, Haut.AI or their licensors. You may use your result for your own personal use. You keep the rights to your own photo. You allow us, and Haut.AI on our behalf, to process your photo and answers only for the purposes and for the periods set out in our privacy policy. Haut.AI may also use information that has been aggregated or anonymised, so that it no longer identifies you, to improve its services, as described in that policy.

8. Availability

We do our best to keep the test working and accurate, but we do not promise that it will always be available, free of errors or suitable for your device. We may change, pause or stop the test, for example for maintenance or because of technical limits.

9. Liability

We are liable for damage caused by our intent or gross negligence, and for anything that the law does not allow us to limit. Apart from that, we are not liable for decisions you make based on the indicative results of the test, or for temporary interruptions of the test. Nothing in these terms limits your statutory rights as a consumer.

10. Changes to these terms

We may update these terms. The version and date are always shown at the top. If we make a change that matters to you, we tell you before it takes effect, and where the law requires it we ask for your consent again.

11. Applicable law and contact

Dutch law applies to these terms. If you are a consumer, you keep the protection of the mandatory rules of the country where you live. Disputes go to the competent court in the Netherlands, unless mandatory consumer law gives you the right to go to the court where you live.
